Terms of Service

These Terms govern your use of Hiateus. Please read them together with Hiateus’s Privacy Policy. Sections marked below as pending confirmation are intentionally left general until reviewed by a licensed attorney, rather than filled in with boilerplate that hasn’t been vetted for this business.
1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of the Hiateus website and, once published, the Hiateus mobile application (together, the “Service”), operated by Hiateus. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility and Use by Minors
You must be at least 18 years old to use the Service. The Service is not directed to, and should not be used by, anyone younger than that. If you are a parent or guardian and believe a minor has used the Service, please contact us using the details in Legal Contact.
3. Description of the Service
Hiateus is a travel decision-support tool. You provide a departure location and a few trip circumstances (dates or flexibility, trip length, traveler count, budget, and an optional “vibe” or “surprise me” preference), and Hiateus returns one recommended destination (a “Hiateus Pick”), along with supporting information such as estimated pricing, weather, and local activities.
Hiateus is a recommendation and decision-support engine. It is not a flight or hotel search engine, a booking system, a travel agency, an airline, a hotel, an insurer, or a transportation provider, except where this document or the Service expressly states otherwise.
4. Nature of the Information Provided
Information shown by the Service falls into different categories, and the Service labels which category applies wherever practical:
- Modeled or estimated: flight and lodging cost estimates, and typical/seasonal weather, are Hiateus’s own modeled figures unless clearly labeled as live.
- Historical or typical: weather shown for dates outside a live forecast’s range reflects typical conditions for that time of year, not a forecast or a guarantee.
- Cached: some information is served from a short-lived cache of a previous, genuinely live request rather than fetched fresh for every single page view.
- Live: information is only described as “live” when it was actually retrieved from a live third-party provider for that request.
Hiateus does not guarantee that any price, schedule, availability, weather condition, event, entry requirement, or booking term shown by the Service is accurate, current, or will remain available. All such information can change after it is shown to you and before you complete a booking elsewhere.
5. Your Responsibility to Verify Information
You are responsible for independently verifying all travel information — including price, schedule, availability, baggage and fare rules, weather, event details, and passport, visa, and other entry requirements — directly with the relevant airline, hotel, event organizer, government authority, or booking provider before you purchase or travel. Do not rely on the Service as your sole source of truth for any travel decision.
6. Third-Party Services and Booking Providers
The Service may link to, integrate with, or display information from third-party flight, hotel, event, weather, and mapping providers, and from third-party booking providers. Hiateus does not control these third parties and is not responsible for their content, accuracy, availability, security practices, or terms.
When you book through a third-party provider, that provider’s own terms of service, cancellation policy, fare rules, and privacy practices apply to that transaction — not these Terms. Hiateus is not a party to any booking, purchase, or contract you make with a third-party provider.
7. Affiliate Relationships
Hiateus may participate in affiliate or referral programs and may receive compensation when you follow a booking link from the Service and complete a purchase. This does not increase the price you pay. See Hiateus’s Privacy Policy for more detail.
8. Accounts and Account Security
The Service does not currently require or offer a user account. If accounts are introduced in the future, this section will be updated to describe your responsibilities for keeping your credentials confidential and for activity that occurs under your account.
9. Acceptable Use
You agree not to, and not to attempt to:
- Scrape, crawl, or systematically extract data from the Service using automated means, except as permitted by a published robots.txt or an explicit written agreement with Hiateus.
- Interfere with, disrupt, or place unreasonable load on the Service, including its search, weather, or affiliate-redirect systems.
- Circumvent rate limits, quotas, or other technical restrictions the Service applies.
- Reverse engineer, decompile, or disassemble any part of the Service, except to the extent applicable law expressly permits despite this restriction.
- Use the Service to violate any applicable law, or to infringe the rights of Hiateus or any third party.
- Misrepresent your identity or affiliation, or impersonate any person or entity, in connection with the Service.
10. Intellectual Property
The Service, including its software, design, layout, text, graphics, and the Hiateus name, logo, and other branding elements, is owned by Hiateus or its licensors and is protected by intellectual-property laws. Except for the limited right to access and use the Service for its intended purpose, these Terms do not grant you any right, title, or interest in the Service, its content, or Hiateus’s trademarks.
11. User Feedback and Submitted Content
If you submit feedback, suggestions, or other content to Hiateus (for example, through a trip-feedback control or a future support channel), you grant Hiateus a non-exclusive, worldwide, royalty-free, sublicensable license to use that feedback to operate, maintain, and improve the Service, without any obligation to compensate you.
12. Paid Features and Subscriptions
The Service does not currently offer any paid features, subscriptions, or in-app purchases of its own — Hiateus does not process payments today. If paid features are introduced, this section will be updated before launch to describe applicable billing, renewal, cancellation, and refund terms.
13. Service Modifications and Discontinuation
Hiateus may modify, suspend, or discontinue any part of the Service, including specific features, at any time, with or without notice. Hiateus is not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
Without limiting the foregoing, Hiateus does not guarantee or warrant:
- That any recommendation reflects the lowest available price or objectively the “best” possible trip.
- That any information is live unless the Service actually labels it as live for that request.
- Uninterrupted, error-free, or secure operation of the Service.
- That any booking you attempt through a third-party provider will succeed.
- The accuracy of any displayed weather condition, forecast, or seasonal typical-weather estimate.
- The availability, accuracy, or continued existence of any displayed local event.
- The performance, reliability, safety, or conduct of any airline, hotel, or other third-party provider referenced by the Service.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIATEUS AND ITS OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY THIRD-PARTY BOOKING, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. HIATEUS’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID HIATEUS DIRECTLY, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless Hiateus and its officers, employees, and service providers from any claim, liability, damage, or expense (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Service, except to the extent caused by Hiateus’s own breach of these Terms or violation of applicable law.
17. Suspension and Termination
Hiateus may suspend or terminate your access to the Service at any time if Hiateus reasonably believes you have violated these Terms or created risk or legal exposure for Hiateus. You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.
18. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, except to the extent applicable law requires otherwise.
Texas is Hiateus’s working assumption for governing law, based on its current Houston-modeled market — it has not been finalized as a legal or business decision and should be confirmed (ideally by counsel) before this policy is treated as final.
19. Dispute Resolution
Hiateus has not yet finalized its dispute-resolution provisions, including whether disputes will be handled through arbitration, small-claims court, or another forum, and this section is intentionally left general pending review by a licensed attorney. Nothing in these Terms should be read, until this section is updated, as requiring arbitration, waiving your right to a jury trial, waiving your ability to participate in a class action, or shortening any legal deadline that would otherwise apply to you under applicable law.
20. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.
21. Entire Agreement
These Terms, together with Hiateus’s Privacy Policy, constitute the entire agreement between you and Hiateus regarding the Service, and supersede any prior agreements between you and Hiateus regarding the Service.
22. Changes to These Terms
Hiateus may update these Terms as the Service changes. If a change is significant, Hiateus will update the “Last updated” date above and, where practical, provide additional notice on the website before the change takes effect. Continuing to use the Service after an update constitutes acceptance of the revised Terms.
23. Legal Contact Information
Hiateus has not yet published a dedicated legal-notice email address. This section will be completed with real contact details before these Terms are treated as final and before Hiateus is made available to the public.
